I don't have insurance but I'm not at fault. Can I get an accident replacement vehicle?Yes, under Australian law, you are entitled to a like-for-like accident replacement vehicle if the accident wasn’t your fault regardless of whether you have insurance.

Is Need2Drive able to assist me if the at fault driver isn't insured?Unfortunately, if you’re aware the at fault driver does not have insurance, in this instance, we won’t be able to help you with an accident replacement vehicle. Please get in touch with your own insurer for assistance. In some circumstances, we will pursue the at fault driver who is liable for damages. If the at fault driver is not insured, our team will discuss this with you and assist you through the process. However, it may limit the extent of the support we are able to provide.

What happens if my car isn't drivable or isn't roadworthy after an accident?If you are the not at fault driver, we can help you to arrange a towing service. If there is a dispute in liability with the at fault driver, what happens?If the at fault party disputes liability, we can’t provide you with an accident loan car until liability is confirmed. However, we will contact the at fault driver’s insurer and confirm if there is a dispute in liability.

Am I eligible for an accident loan car?We provide vehicles to not at fault drivers who have been in a collision involving a vehicle owned or operated by another insured party. If your vehicle has been damaged by a straying animal (farm animal or pet) that has an owner and fault is acknowledged, you may be eligible for an accident replacement vehicle. I don't have the at fault driver's details, can I get an accident replacement vehicle?It is important in any accident to ensure you get the details of the other driver, regardless of fault, including car registration and insurance information. Unfortunately, without these details we are unable to provide a vehicle at no cost to you, as the cost of the accident loan car is recovered through the at fault party or their insurer.

Am I eligible for an accident loan car?We provide vehicles to not at fault drivers who have been in a collision involving a vehicle owned or operated by another insured party. In the case of a collision with a kangaroo or wild animal, we recommend reaching out to your insurer.

Can I get an accident replacement vehicle if my car was stolen?Need2Drive can only assist not at fault drivers who have been in an accident with an insured at fault driver. If your car was stolen and you have insurance, we recommend contacting your insurance provider.

My own car broke down and repairs will take several days. Can I rent a car from Need2Drive?Our accident replacement vehicles are only available for eligible drivers who are not at fault in an accident with an insured at fault driver. Unfortunately, we can’t assist in this scenario.

Am I eligible for a loan car if I had an accident in a business/company car?Yes, if you’re not at fault in an accident with another vehicle, the business has a legal right to be put back into the position it was prior to the accident. This means that the business may be legally entitled to an accident loan car whilst the car is being repaired, or until it is deemed a total loss. As the not at fault driver, what are my obligations when I get a loan car from Need2Drive?Your obligations are to comply with the terms of our agreement with you which includes: Acting in the best interest of Need2Drive. Not holding up the recovery of the rental costs from the at fault party. Providing all documents reasonably required (for example, a copy of your physical driver’s licence). Being open and honest with us, and not misleading us in any way. Not releasing or purporting to release the at fault party from any of your rights in respect to the accident. Providing us with assistance in the recovery process as required, which may include providing documents, witness statements and in very limited circumstances, court proceedings. What are my rights if I am involved in a not at fault vehicle accident?If you’re not at fault in an accident with another vehicle, it’s your legal right to be put back into the position you were in prior to the accident. This means being provided with an accident loan car similar to your own while your car is being repaired, or until your total loss settlement is confirmed.

If I use Need2Drive after a not at fault accident, will it affect my insurance policy?Using our services shouldn’t impact your current policy. When the accident isn’t your fault, you’ve got rights that mean you don’t have to make a claim against your own insurance policy and the cost of the hire will be recovered from the at fault party or their insurer.

If my vehicle is registered for GST, what happens?If the owner of the vehicle has registered the vehicle for business use, then the owner may be required to pay the GST component of the hire cost at the end of the hire period. The owner is entitled to claim back the GST on their Business Activity Statement (BAS). Is there a reason why I have to pay for petrol and tolls when I am not at fault?You will need to pay for these additional items as you would in your own car. The at fault insurer will not cover the cost of these items.

What consequences are there for me if the at fault insurer doesn't pay the bill?Provided you assist us in the recovery process and otherwise act in accordance with the terms and conditions of our agreement, you will be released from liability for the rental costs or legal fees associated with the recovery.

Why do you collect my credit card details when I am not at fault?We collect your credit card details in case we need to process charges at the end of your hire such as: Fuel (if you return the vehicle with less fuel that when it was provided to you) Tolls Traffic or parking infringements Vehicle cleaning (if the vehicle is returned dirty) Unacceptable wear & tear Excess or damage Administrative costs

What costs do I need to cover as the not at fault driver?Under our agreement with you, you will not be liable for the rental costs provided you are not at fault, assist us in recovery of those costs from the at fault driver or their insurer and otherwise act in accordance with the terms and conditions of our agreement. If we require your assistance in recovering the rental costs, this may include you having to provide documents, statements, and in very limited circumstances, court proceedings. You are responsible for vehicle use costs such as: Fuel Tolls (and their related administrative fees) Traffic or parking infringements (and their related administrative fees). In some circumstances, you may also be required to pay costs related to: Vehicle cleaning for a vehicle returned in poor condition Unacceptable wear & tear Excess or damage if you damage our vehicle and do not abide by the terms and conditions of our agreement.

Who is responsible for the cost of the accident replacement vehicle?Under our agreement with you, the not at fault driver, you won’t be liable for the rental costs as long as you are not at fault, you assist us in the recovery of the costs from the at fault party or their insurer, and otherwise act in accordance with the terms and conditions of our agreement. If we require your assistance in recovering the rental costs, this may include you having to provide documents, witness statements, and in very limited circumstances, court proceedings. You’ll still need to pay for petrol, tolls and infringements as you would in your own car.

If I apply for a loan car, how long will it take to assess my application?It takes between 24-48 hours to assess an application depending on liability confirmation from the at fault party’s insurer. Will I need to pay if I have an accident in a Need2Drive loan car?Please contact us as soon as possible to inform us if you’ve had an accident so we can assist you. Pursuant to the terms and conditions of your rental agreement, your damage liability fee will be reduced to zero, provided that: The accident is reported to us immediately Complete accident details including description, date and time of accident, location of accident and details of all parties involved are provided within 24 hours of occurrence; and The driver is fully licenced and an authorised driver (nominated on the rental agreement). If you are unable to do so, you will be liable for the loss and damage caused.

Does the vehicle need to be returned with a full tank of fuel?All our vehicles are provided to our customers with a full fuel tank and, like any rental car, need to be returned to us with a full tank of fuel to avoid additional charges.

Can I take my pets with in the car?Pets are not allowed in any of our accident loan cars and will incur an additional cleaning fee. Assistance animals are an exception, so please contact our team on 0405 423 423 to register for this.

What are the consequences for malicious damage to a Need2Drive vehicle?In the event of malicious damage (intending to cause damage to the property, or an intention to destroy it) to one of our vehicles, you may be liable for all losses and damages caused. Why has Need2Drive charged my credit card?There are several reasons why your credit card may have been charged and the list below covers the most common reasons: Tolls + an administrative fee Traffic or parking infringements + an administration fee Additional fees if the car is not returned in the same condition that you received it in Cleaning fees Refuelling charges. Am I allowed to smoke in the car?Smoking is NOT permitted in any of our accident loan cars and will incur an additional cleaning fee.

OverviewIf you have been involved in a motor vehicle collision with one of our customers and have been identified as the at fault party, you may receive a request to pay for the cost of the accident replacement vehicle incurred by our customer. This is because the not at fault party is legally entitled to be placed back in the same position they were in prior to the collision. The cost is for the accident replacement vehicle whilst their own vehicle was being repaired, or in the event of a total loss, pending the pay out to allow them to arrange another vehicle. If you are insured, you should refer the request for payment to your insurer and provide, as requested, your insurer details and claim number. If you have not provided your insurer details, you should immediately contact 0405 423 423 to confirm your insurer’s name and your claim number. This will ensure all future communications, if possible, are limited to your insurer. If you are insured, have met all policy obligations, and paid your excess, you should not be out of pocket. After all, this is why you have insurance. If you are not insured, you should immediately contact 0405 423 423 to arrange payment of the cost of the accident replacement vehicle.

I have lodged a claim with my insurer and provided my claim number. Why am I being contacted directly?We recommend you contact your insurer to confirm they have received a copy of the request for payment and ask that they contact our recovery agent, Redwood Services, to arrange payment. We suggest you forward copies of all emails and text messages for their attention. If you have provided your insurance company details and claim number, Redwood Services will contact your insurer. It is only if responses to requests are ignored or unreasonable offers for the cost of the accident replacement vehicle are made that you may be contacted directly.

I am insured and have made a claim. Will this cost me anything?If you hold a valid insurance policy, have lodged a claim, have met your policy obligations, and have paid your excess, your insurance company should provide indemnity and satisfy the accident replacement vehicle invoice. You should not need to pay anything extra.

I am not insured. What should I do?If you did not hold a valid insurance policy at the time of the collision, it will be necessary that you immediately contact Redwood Services to arrange payment of the cost of the accident replacement vehicle incurred by our customer as a result of you causing the collision. Any delays may result in legal proceeding being issued against you personally, which will incur additional costs.

Your customer has insurance, so why have they not lodged a claim with their own insurer?There is no obligation on the not at fault party to lodge a claim with an insurer just because they hold a valid insurance policy. A driver can choose to recover their losses directly from the at fault driver.

I am insured. Why have I been served with court documents? What should I do?If you held a valid insurance policy at the time of the collision, have lodged a claim, and have met your policy obligations, legal proceedings may still have been issued against you. The reason for this is either because a reasonable settlement could not be reached between Right2Drive and your insurer, or your insurer has not responded to our reasonable requests. If you have been served with court documents, you should immediately provide a copy to your insurer to ensure your interests are protected. You should not delay contacting your insurer as strict time frames apply.

I am insured. Why have I been named as a defendant?As you have been identified as the at fault driver, you are legally responsible for the loss and damage you have caused to the not at fault driver who is our customer. If you held a valid insurance policy at the time of the collision, your insurer should indemnify you and you should not be out of pocket.

My insurer is not responding to my requests to resolve the hire car claim. What should I do?Although we cannot provide advice as to what you should do, you may wish to consider seeking an Internal Review with your insurer or request the claim be reviewed by the Australian Financial Complaints Authority (AFCA). When you say like-for-like vehicle, what does this mean?“Like-for-like” means an equivalent vehicle to your vehicle that was involved in the not at fault accident.
